       外本国人、无国籍人的大作率先在中国门内问世的,按照此法享有著作权。

       三十二条著作权人应该依照合约说定限期交给大作。

       广播无线电台、电视机台播放人家已抒的大作,得以不经著作权人许可,但是应该支出酬劳。

       四十七条当事者不执行合约无偿或执行合约无偿不合合说定环境的,应该依照民法通则关于规程担待民事义务。

       著作权人得以全体或有些出让本条头款第(五)项至第(十七)项规程的权,并依照说定或此法有关规程博得酬劳。

       第十五条影戏、电视机、录像大作的导演、剧作者、作词、谱曲、留影等作者享有具名权,著作权的其它权由制造影戏、电视机、录像大作的制片者享有。

       著作权伙保管组织好坏赚性组织,其设立方式、权无偿、著作权许可应用费的收执和分红,以及对其督察和保管等由国事院另行规程。

       依据海内相干组织的渴求和相干国际公约的规程,送审稿将留影大作的掩护期改动为笔者终生及死后五旬。

eauthorofaworkisthecitizenwhohascreatedthework.Whereaworkiscreatedaccordingtothewillandunderthesponsorshipandtheresponsibilityofalegalorentitywithoutlegalpersonality,suchlegalpersonorentitywithoutlegalpersonalityshallbedeemedtobetheauthorofthework.Thecitizen,legalpersonorentitywithoutlegalpersonalitywhosenameisindicatedonaworkshall,intheabsenceofprooftothecontrary,bedeemedtobetheauthoroftheworkArticle12Whereaworkiscreatedbyadaptation,translation,annotationorarrangementofapre-existingwork,thecopyrightintheworkthuscreatedshallbeenjoyedbytheadaptor,translatororarranger,providedthattheexerciseofsuchcopyrightshallnotprejudicethecopyrightintheoriginalwork.Article13Whereaworkiscreatedjointlybytwoormoreco-authors,thecopyrightintheworkshallbeenjoyedjointlybythoseco-authors.Anypersonwhohasnotparticipatedinthecreationoftheworkmaynotclaimtheco-authorship.Ifaworkofjointauthorshipcanbeseparatedintoindependentpartsandexploitedseparately,eachco-authormaybeentitledtoindependentcopyrightinthepartsthathehascreated,providedthattheexerciseofsuchcopyrightshallnotprejudicethecopyrightinthejointworkasawhole.Article14Thecopyrightinaworkcreatedbycompilationshallbeenjoyedbythecompiler,providedthattheexerciseofsuchcopyrightshallnotprejudicethecopyrightinthepreexistingworksincludedinthecompilation.Theauthorsofsuchworksincludedinacompilationascanbeexploitedseparatelyshallbeentitledtoexercisetheircopyrightintheirworksindependently.Article15Thedirector,screenwriter,lyricist,composer,cameramanandotherauthorsofacinematographic,televisionorvideo-graphicworkshallenjoytherightofauthorshipinthework,whiletheotherrightsincludedinthecopyrightshallbeenjoyedbytheproducerofthework.Theauthorsofscreenplay,musicalworksandotherworksthatareincludedinacinematographic,televisionorvideo-graphicworkandcanbeexploitedseparatelyshallbeentitledtoexercisetheircopyrightindependently.Article16Aworkcreatedbyacitizeninthefulfillmentoftasksassignedtohimbyalegalpersonorentitywithoutlegalpersonalityshallbedeemedtobeaworkcreatedinthecourseofemployment.Thecopyrightinsuchaworkshall,subjecttotheprovisionsofthesecondparagraphofthisArticle,beenjoyedbytheauthor,providedthatthelegalpersonorentitywithoutlegalpersonalityshallhavearightofprioritytoexploittheworkwithinthescopeofitsprofessionalactivities.Duringthetwoyearsafterthecompletionofthework,theauthormaynot,withouttheconsentofthelegalpersonorentitywithoutlegalpersonality,authorizeathirdpartytoexploittheworkintthesamewayasthelegalpersonorentitywithoutlegalpersonalitydoes.Theauthorofaworkcreatedinthecourseofemploymentinoneofthefollowingcircumstancesshallenjoytherightofauthorship,whilethelegalpersonorentitywithoutlegalpersonalityshallenjoytheotherrightsincludedinthecopyrightandmayrewardtheauthor:(1)drawingsofengineeringdesignsandproductdesignsanddescriptionsthereof;computersoftware;mapsandotherworkscreatedinthecourseofemploymentmainlywiththematerialandtechnicalresourcesofthelegalpersonorentitywithoutlegalpersonalityandunderitsresponsibility;(2)workscreatedinthecourseofemploymentwherethecopyrightis,inaccordancewithlaws,administrativerulesandregulationsorcontractsconcerned,enjoyedbythelegalpersonorentitywithoutlegalpersonality.Article17Theownershipofcopyrightinacommissionedworkshallbeagreeduponinacontractbetweenthecommissioningandthecommissionedparties.Intheabsenceofacontractorofanexplicitagreementinthecontract,thecopyrightinsuchaworkshallbelongtothecommissionedparty.Article18Thetransferofownershipoftheoriginalcopyofaworkoffineart,orotherworks,shallnotbedeemedtoincludethetransferofthecopyrightinsuchwork,providedthattherighttoexhibittheoriginalcopyofaworkoffineartshallbeenjoyedbytheownerofsuchoriginalcopy.Article19Wherethecopyrightinaworkbelongstoacitizen,therightofexploitationandtherighttoremunerationinrespectoftheworkshall,afterhisdeath,duringthetermofprotectionprovidedforinthisLaw,betransferredinaccordancewiththeprovisionsoftheLawofSuccession.Wherethecopyrightinaworkbelongstoalegalpersonorentitywithoutlegalpersonality,therightofexploitationandtherighttoremunerationshall,afterthechangeortheterminationofthelegalpersonorentitywithoutlegalpersonality,duringthetermofprotectionprovidedforinthisLaw,beenjoyedbythesucceedinglegalpersonorentitywithoutlegalpersonalitywhichhastakenovertheformer\srightsandobligations,or,intheabsenceofsuchasuccessorentity,bythestate.Section3TermofProtectionofRightsArticle20Thetermofprotectionoftherightsofauthorship,alteration,andintegrityofanauthorshallbeunlimited.Article21Thetermofprotectionoftherightofpublication,therightofexploitationandtherighttoremunerationinrespectofaworkofacitizenshallbethelifetimeoftheauthorandfiftyyearsafterhisdeath,expiringonDecember31ofthefiftiethyearafterhisdeath.Inthecaseofaworkofjointauthorship,suchtermshallexpireonDecember31ofthefiftiethyearafterthedeathofthelastsurvivingauthor.Thetermofprotectionoftherightofpublication,therightofexploitationandtherighttoremunerationinrespectofaworkwherethecopyrightbelongstoalegalpersonorentitywithoutlegalpersonality,orinrespectofaworkcreatedinthecourseofemploymentwherethelegalpersonorentitywithoutlegalpersonalityenjoysthecopyright(excepttherightofauthorship),shallbefiftyyears,expiringonDecember31ofthefiftiethyearafterthefirstpublicationofsuchwork,providedthatanysuchworkthathasnotbeenpublishedwithinfiftyyearsafterthecompletionofitscreationshallnolongerbeprotectedunderthisLaw.Thetermofprotectionoftherightofpublication,therightofexploitationandtherighttoremunerationinrespectofacinematographic,television,video-graphicorphotographicworkshallbefiftyyears,expiringonDecember31ofthefiftiethyearafterthefirstpublicationofsuchwork,providedthatanysuchworkthathasnotbeenpublishedwithinfiftyyearsafterthecompletionofitscreationshallnolongerbeprotectedunderthisLaw.Section4LimitationsonRightsArticle22Inthefollowingcases,aworkmaybeusedwithoutpermissionfrom,andwithoutpaymentofremunerationto,thecopyrightowner,providedthatthenameoftheauthorandthetitleoftheworkshallbeindicatedandtheotherrightsenjoyedbythecopyrightownerbyvirtueofthisLawshallnotbeprejudiced:(1)useofapublishedworkofothersfortheuser\sownprivatestudy,researchorselfentertainment;(2)appropriatequotationfromapublishedworkofothersinone\sworkforthepurposesofintroductionto,orcommenton,awork,ordemonstrationofapoint;(3)useofapublishedworkinnewspapers,periodicals,radioprogrammes,televisionprogrammesornewsreelsforthepurposeofreportingcurrentaffairs;(4)reprintingbynewspapersorperiodicals,orrebroadcastingbyradiostationsortelevisionstations,ofeditorialsorcommentator\sarticlespublishedbyothernewspapers,periodicals,radiostationsortelevisionstations;(5)publicationinnewspapersorperiodicals,orbroadcastingbyradiostationsortelevisionstations,ofaspeechdeliveredatapublicgathering,exceptwheretheauthorhasdeclaredthatthepublicationorbroadcastingisnotpermitted;(6)translationorreproductioninasmallquantityofcopies,ofapublishedworkforusebyteachersorscientificresearchers,inclassroomteachingorscientificresearch,providedthatthetranslationorreproductionshallnotbepublishedordistributed;(7)useofapublishedworkbyastateorganforthepurposeofperformingitsofficialduties;(8)reproductionofaworkinitscollectionsbyalibrary,anarchivescenter,amemorialhall,amuseum,anartgalleryorasimilarinstitution,forthepurposesofdisplay,orpreservationofacopy,ofthework;(9)freeperformanceofapublishedwork;(10)copying,drawing,photographing,orvideorecordingofanartisticworklocatedorondisplayinanoutdoorpublicplace;(11)translationofapublishedworkfromthelanguageoftheHannationalityintominoritynationalitylanguagesforpublicationanddistributioninthecountry;(12)transliterationofapublishedworkintoBrailleandpublicationoftheworksotransliterated.Theabovelimitationsonrightsshallbeapplicablealsototherightsofpublishers,performers,producersofsoundrecordingsandvideorecordings,radiostationsandtelevisionstations.ChapterIIICopyrightLicensingContractsArticle23Anyonewhoexploitsaworkcreatedbyothersshall,exceptwherenopermissionisrequiredinaccordancewiththeprovisionsofthisLaw,concludeacontractwith,orotherwiseobtainpermissionfrom,thecopyrightowner.Article24Acontractshallincludethefollowingbasicclauses:(1)themannerofexploitationoftheworkcoveredbythelicense;(2)theexclusiveornonexclusivenatureoftherighttoexploittheworkcoveredbythelicense;(3)thescopeandtermofthelicense;(4)theamountofremunerationandthemethodofitspayment;(5)theliabilityforbreachofcontract;and(6)anyothermatterwhichthecontractingpartiesconsidernecessary.Article25Withoutpermissionfromthecopyrightowner,theotherpartytothecontractshallnotexercisetherightwhichthecopyrightownerhasnotexplicitlylicensedinthecontract.Article26Thetermofvalidityofacontractshallnotexceedtenyears.Thecontractmayberenewedonexpirationofthatterm.Article27ThetariffsofremunerationfortheexploitationofworksshallbeestablishedbythecopyrightadministrationdepartmentundertheStateCounciljointlywithotherdepartmentsconcerned.Whereotherwiseagreedtoinacontract,remunerationmaybepaidinaccordancewiththetermsofthesaidcontract.Article28Publishers,performers,producersofsoundrecordingsandvideorecordings,radiostations,televisionstationsandotherentitieswhoorwhichhave,pursuanttothisLaw,obtainedtherightofexploitationincludedinthecopyrightofothers,shallnotprejudicesuchauthors\rightsofauthorship,alteration,integrityandtheirrighttoremuneration.ChapterIVPublication,Performance,SoundRecording,VideoRecor-dingandBroadcastingSection1PublicationofBooks,NewspapersandPeriodicalsArticle29Abookpublisherwhopublishesabookshallconcludeapublishingcontractwith,andpayremunerationto,thecopyrightowner.Article30Abookpublishershall,duringthetermofthecontract,haveanexclusiverighttopublishtheworkdeliveredtohimforpublicationbythecopyrightowner.Thetermoftheexclusiverighttopublishthework,enjoyedbythebookpublisherasspecifiedinthecontract,shallnotexceedtenyears.Thecontractmayberenewedonexpirationofthatterm.Theexclusiverighttopublishaworkenjoyedbythebookpublishershall,duringthetermspecifiedinthecontract,beprotectedbylaw,andtheworkmaynotbepublishedbyothers.Article31Thecopyrightownershalldelivertheworktothepublisherwithinthetimelimitspecifiedinthecontract.Thebookpublishershallpublishtheworkaccordingtothequalityrequirementsandwithinthetimelimitspecifiedinthecontract.ThebookpublishershallbearthecivilliabilityinaccordancewiththeprovisionsofArticle47ofthisLawifhefailstopublishtheworkwithinthetimelimitspecifiedinthecontract.Thebookpublishershallnotify,andpayremunerationto,thecopyrightownerwhentheworkistobereprintedorrepublished.Ifthebookpublisherrefusestoreprintorrepublishtheworkwhenthestocksofthebookareexhausted,thecopyrightownershallhavetherighttoterminatethecontract.Article32Whereacopyrightownerhassubmittedthemanuscriptofhisworktoanewspaperoraperiodicalpublisherforpublicationandhasnotreceivedanynotificationofthesaidpublisher\sdecisiontopublishthework,withinfifteendaysfromthenewspaperpublisherorwithinthirtydaysfromtheperiodicalpublisherfromthedateofsubmissionofthemanuscript,thecopyrightownermaysubmitthemanuscriptofthesameworktoanothernewspaperorperiodicalpublisherforpublicationunlessthetwopartieshaveagreedotherwise.Afteraworkispublishedinanewspaperoraperiodical,othernewspaperorperiodicalpublishermay,exceptwherethecopyrightownerhasdeclaredthatreprintingorexcerptingisnotpermitted,reprinttheworkorprintanabstractofitorprintitasreferencematerial,butsuchotherpublishersshallpayremunerationtothecopyrightownerasprescribedinregulations.Article33Abookpublishermayalterorabridgeaworkwiththepermissionofthecopyrightowner.Anewspaperpublisherorperiodicalpublishermaymakeeditorialmodificationsandabridgmentsinawork,butshallnotmakeanymodificationsinthecontentoftheworkunlesspermissionhasbeenobtainedfromtheauthor.Article34Whenpublishingaworkcreatedbyadaptation,translation,annotation,arrangementorcompilationofapre-existingwork,thepublishershallpayremunerationbothtotheownerofthecopyrightintheworkcreatedbyadaptation,translation,annotation,arrangementorcompilation,andtotheownerofthecopyrightintheoriginalwork.Section2PerformanceArticle35Aperformer(anindividualperformeroraperformingtroupe)whoforaperformanceexploitsanunpublishedworkcreatedbyothersshallobtainpermissionfrom,andpayremunerationto,thecopyrightowner.Aperformerwhoforacommercialperformanceexploitsapublishedworkcreatedbyothersdoesnotneedpermissionfrom,butshall,asprescribedbyregulations,payremunerationtothecopyrightowner;suchworkshallnotbeexploitedwherethecopyrightownerhasdeclaredthatsuchexploitationisnotpermitted.Aperformerwhoforacommercialperformanceexploitsaworkcreatedbyadaptation,translation,annotationorarrangementofapre-existingworkshallpayremunerationbothtotheownerofthecopyrightintheworkcreatedbyadaptation,translation,annotationorarrangementandtotheownerofthecopyrightintheoriginalwork.Whereaperformerperformsaworkcreatedbyothersforthepurposeofproducingasoundrecording,videorecording,radioprogrammeortelevisionprogramme,theprovisionsofArticle37and40ofthisLawshallapply.Article36Aperformershall,inrelationtohisperformance,enjoytheright:(1)toclaimperformership;(2)toprotecttheimageinherentinhisperformancefromdistortion;(3)toauthorizeotherstomakelivebroadcasts;and(4)toauthorizeotherstomakesoundrecordingsandvideorecordingsforcommercialpurposes,andtoreceiveremunerationtherefor.Section3SoundRecordingandVideoRecordingArticle37Aproducerofsoundrecordingswho,fortheproductionofasoundrecording,exploitsanunpublishedworkcreatedbyothersshallobtainpermissionfrom,andpayremunerationto,thecopyrightowner.Aproducerofsoundrecordingswho,fortheproductionofasoundrecording,exploitsapublishedworkcreatedbyothers,doesnotneedpermissionfrom,butshall,asprescribedbyregulations,payremunerationto,thecopyrightowner;suchworkshallnotbeexploitedwherethecopyrightownerhasdeclaredthatsuchexploitationisnotpermitted.Aproducerofvideorecordingswho,fortheproductionofavideorecording,exploitsaworkcreatedbyothersshallobtainpermissionfrom,andpayremunerationto,thecopyrightowner.Aproducerofsoundrecordingsorvideorecordingswhoexploitsaworkcreatedbyadaptation,translation,annotationorarrangementofapre-existingworkshallpayremunerationbothtotheownerofthecopyrightintheworkcreatedbyadaptation,translation,annotationorarrangement,andtotheownerofthecopyrightintheoriginalwork.Article38Whenproducingasoundrecordingorvideorecording,theproducershallconcludeacontractwith,andpayremunerationto,theperformer.Article39Aproducerofsoundrecordingsorvideorecordingsshallhavetherighttoauthorizeotherstoreproduceanddistributehissoundrecordingsorvideorecordingsandtherighttoreceiveremunerationtherefor.Thetermofprotectionofsuchrightsshallbefiftyyears,expiringonDecember31ofthefiftiethyearafterthefirstpublicationoftherecordings.Aproducerofsoundrecordingsorvideorecordingswhoisauthorizedtoreproduceanddistributeasoundrecordingorvideorecordingcreatedbyothersshallalsopayremunerationtothecopyrightownerandtotheperformerasprescribedbyregulations.Section4BroadcastingbyRadioStationorTelevisionStationArticle40Aradiostationortelevisionstationwhichexploits,fortheproductionofaradioortelevisionprogramme,anunpublishedworkcreatedbyothers,shallobtainpermissionfrom,andpayremunerationto,thecopyrightowner.Aradiostationortelevisionstationwhichexploits,fortheproductionofaradioortelevisionprogramme,apublishedworkcreatedbyothersdoesnotneedpermissionfromthecopyrightowner,butsuchaworkshallnotbeexploitedwherethecopyrightownerhasdeclaredthatsuchexploitationisnotpermitted.Inaddition,remunerationshallbepaidasprescribedbyregulationsunlessthisLawprovidesthatnoremunerationneedstobepaid.Aradiostationortelevisionstationwhichexploits,fortheproductionofaradioortelevisionprogramme,aworkcreatedbyadaptation,translation,annotation,orarrangementofapre-existingwork,shallpayremunerationbothtotheownerofthecopyrightintheworkcreatedbyadaptation,translation,annotationorarrangementandtotheownerofthecopyrightintheoriginalwork.Article41Whenproducingaradioortelevisionprogramme,theradiostationortelevisionstationshallconcludeacontractwith,andpayremunerationto,theperformer.Article42Aradiostationortelevisionstationshall,inrespectofaprogrammeproducedbyit,enjoytheright:(1)tobroadcasttheprogramme;(2)toauthorizeotherstobroadcasttheprogramme,andtoreceiveremunerationtherefor;and(3)toauthorizeotherstoreproduceanddistributetheradioortelevisionprogramme,andtoreceiveremunerationtherefor.Thetermofprotectionoftherightsspecifiedintheprecedingparagraphshallbefiftyyears,expiringonDecember31ofthefiftiethyearafterthefirstbroadcastingoftheprogramme.Aproducerofsoundrecordingsorvideorecordingswhoisauthorizedtoreproduceanddistributearadioortelevisionprogrammeshallalsopayremunerationtothecopyrightownerandtheperformerasprescribedbyregulations.Article43Aradiostationortelevisionstationmaybroadcast,fornoncommercialpurposes,apublishedsoundrecordingwithoutseekingpermissionfrom,orpayingremunerationto,thecopyrightowner,performerandproducerofthesoundrecording.Article44Atelevisionstationwhichbroadcastsacinematographic,televisionorvideo-graphicworkproducedbyothersshallobtainpermissionfrom,andpayremunerationto,theproducerofthecinematographic,televisionorvideo-graphicwork.ChapterVLegalLiabilityArticle45Anyonewhocommitsanyofthefollowingactsofinfringementshallbearcivilliabilityforsuchremediesasceasingtheinfringingact,eliminatingitsilleffects,makingapublicapologyorpayingcompensationordamages,etc.,dependingonthecircumstances:(1)publishingaworkwithoutthepermissionofthecopyrightowner;(2)publishingaworkofjointauthorshipasaworkcreatedsolelybyoneselfwithoutthepermissionoftheotherco-authors;(3)havingone\snameindicatedonaworkcreatedbyothers,inordertoseekpersonalfameandgain,whereonehasnotparticipatedinthecreationofthework;(4)distortingormutilatingaworkcreatedbyothers;(5)exploitingaworkbyperformance,broadcasting,exhibition,distribution,makingcinematographic,televisionorvideoproductions,adaptation,translation,annotation,andcompilation,orbyothermeans,withoutthepermissionofthecopyrightowner,unlessotherwiseprovidedinthisLaw;(6)exploitingaworkcreatedbyotherswithoutpayingremunerationasprescribedbyregulations;(7)broadcastingaliveperformancewithoutthepermissionoftheperformer;or(8)committingotheractsofinfringementofcopyrightandofotherrightsandinterestsrelatedtocopyright.Article46Anyonewhocommitsanyofthefollowingactsofinfringementshallbearcivilliabilityforsuchremediesasceasingtheinfringingact,eliminatingitsilleffects,makingapublicapologyorpayingcompensationfordamages,etc.,dependingonthecircumstances,andmay,inaddition,besubjectedbythecopyrightadministrationdepartmenttosuchadministrativepenaltiesasconfiscationofunlawfulincomefromtheact,orimpositionofafine:(1)plagiarizingaworkcreatedbyothers;(2)reproducinganddistributingawork,forcommercialpurposes,withoutthepermissionofthecopyrightowner;(3)publishingabookwheretheexclusiverightofpublicationbelongstoanotherpublisher;(4)producingandpublishingasoundrecordingorvideorecordingofaperformancewithoutthepermissionoftheperformer;(5)reproducinganddistributingasoundrecordingorvideorecordingproducedbyotherswithoutthepermissionofitsproducer;(6)reproducinganddistributingaradioprogrammeortelevisionprogrammewithoutthepermissionoftheradiostationortelevisionstationwhichhasproducedthatprogramme;or(7)producingorsellingaworkoffineartwherethesignatureoftheauthorisforged.Article47Apartywhofailstoperformhiscontractualobligations,orperformstheminamannerwhichisnotinconformitywiththeagreedtermsshallbearcivilliabilityinaccordancewiththerelevantprovisionsoftheGeneralPrinciplesoftheCivilLaw.Article48Adisputeovercopyrightinfringementmaybesettledbymediation.Ifmediationisunsuccessful,orifoneofthepartiesretractsfromhispromiseafteramediationagreementisreached,proceedingsmaybeinstitutedinapeople\scourt.Proceedingsmayalsoinstituteddirectlyinapeople\scourtifthepartiesdonotwishtosettlethedisputebymediation.Article49Adisputeoveracopyrightcontractmaybesettledbymediation.Itmayalso,inaccordancewiththearbitrationclauseofcontract,orawrittenarbitrationagreementconcludedafterthecontracthasbeensigned,besubmittedtoacopyrightarbitrationbodyforarbitration.Thepartiesshallimplementthearbitrationaward.Ifoneofthepartiesfailstoimplementtheaward,theotherpartymayapplytoapeople\scourtforexecution.Ifthepeople\scourtwhichhasbeenrequestedtoexecuteanarbitrationawardfindsthatthearbitrationawardiscontrarytolaw,itshallhavetherighttorefusetheexecution.Wherethepeople\scourtrefusestoexecuteanarbitrationaward,thepartiesmayinstituteproceedingsinapeople\scourtforcontractualdispute.Wherenoarbitrationclauseisstipulatedinthecontractandnowrittenarbitrationagreementisconcludedafterthecontracthasbeensigned,anypartymayinstituteproceedingsdirectlyinapeople\scourt.Article50Anypartywhoisnotsatisfiedwithanadministrativepenaltymayinstituteproceedingsinapeople\scourtwithinthreemonthsfromreceiptofthewrittendecisionoftheadministrativepenalty.Ifthepartyneitherinstitutesproceedingsnorexecutesthedecisionwithinthetimelimit,thecopyrightadministrationdepartmentmayapplytoapeople\scourtforexecution.ChapterVISupplementaryProvisionsArticle51ForthepurposeofthisLaw,theterm”zhuzuoquan”(author\srights)issynonymouswiththeterm”banquan”(copyright).Article52Theterm”reproduction”asusedinthisLawmeanstheactofproducingoneormorecopiesofaworkbyprinting,photocopying,copying,lithographing,makingasoundrecordingorvideorecording,duplicatingarecording,orduplicatingaphotographicworkorbyothermeans.Theterm”reproduction”asusedinthisLawdoesnotcovertheconstructionormanufactureofindustrialproductsonthebasisofdrawingsofengineeringdesignsandproductdesigns,anddescriptionsthereof.Article53MeasuresfortheprotectionofcomputersoftwareshallbeestablishedseparatelybytheStateCouncil.Article54TheimplementingregulationsofthisLawshallbedrawnupbythecopyrightadministrationdepartmentundertheStateCouncilandshallenterintoforceafterapprovalbytheStateCouncil.Article55Therightsofcopyrightowners,publishers,performers,producersofsoundrecordingsandvideorecordings,radiostationsandtelevisionstationsasprovidedforinthisLawshall,iftheirtermofprotectionasspecifiedinthisLawhasnotyetexpiredonthedateofentryintoforceofthisLaw,beprotectedinaccordancewiththisLaw.AnyactofinfringementorbreachofcontractcommittedpriortotheentryintoforceofthisLawshallbedealtwithinaccordancewiththerelevantregulationsorpoliciesinforceatthetimewhensuchactwascommitted.Article56ThisLawshallenterintoforceasofJune1,1991.Note:1ThisEnglishversionisthepreliminaryEnglishtranslationprovidedbytheLegislativeAffairsCommissionoftheStandingCommitteeoftheNationalPeople\sCongressofthePeople\sRepublicofChina.ItshallberepublishedafterbeingfurtherrevisedandfinalizedbytheLegislativeAffairsCommissionoftheStandingCommitteeoftheNationalPeople\sCongressofthePeople\sRepublicofChina.-TheEditor,_1_一、在本国何是学问产权法?学问产权法是指因调整学问产权的归于、行使、保管和掩护等活络中发生的社会瓜葛的法度规范的总称。

       四十五条广播无线电台、电视机台有权取缔未经其许可的下列行止:(一)将其播放的广播、电视机转播;(二)将其播放的广播、电视机录制在声像载体上以及复制声像载体。
